What Information Do We Collect?
You also acknowledge and agree that, if you are a Patient, we may collect your Health Information. “Health Information” means any information related to your physical or mental health, including your medical history, family history, health background and current health status information, age information, demographic information, and information related to the diagnosis and treatment of health conditions, prescription medications, laboratory test results, and health insurance information.
You also acknowledge and agree that we may collect location-based data from you (“Location-Based Information”). When you use the Site, Application or Services, we may collect Location-Based Information from your browser or mobile device. To the extent we track your location through, it is only to administer the functionality of the Site, Application or Services.
When you use the Site, Application or Services, whether as a Consumer, Patient or Healthcare Provider, we may collect certain personal information, such as your first and last name, age information, address, email address, mobile phone number, or other demographic information (“Personal Information”). If you are a Consumer, you acknowledge that we may collect this Personal Information from you directly or through your employer (“Employer”). If you are a Patient, you acknowledge that we may collect this Personal Information from you directly, through your Employer or your health insurance provider (“Insurer”) or through your Healthcare Provider. We may ask you or your Insurer or Healthcare Provider to provide Personal Information about you that will enable us to enhance your use of the Site, Application or Services. It is your choice whether or not to provide that Personal Information through the Site, Application or Services; provided that, if, as a Patient, you designate an Insurer or Healthcare Provider, the Healthcare Provider may elect to provide your Personal Information on your behalf. In such case, the Insurer or Healthcare Provider will be solely responsible for obtaining your consent to provide such Personal Information. If you choose not to provide the requested Personal Information, you may not be able to use certain features of the Site, Application or Services.
We may collect and use technical data and related information (“Technical Information”), including but not limited to technical information about your device, system and application software, peripherals, and your interactions with the Site, Application or Services. Technical Information is gathered to facilitate the provisioning of software updates, product support, product enhancements, and other services to you related to the Site, Application or Services. We may also receive and record information on our server logs from your browser or mobile device, which could include your IP address, cookie information, browser information, and the page or screen you request. This information will not be used in a way that associates such information with you. We own this information and may use it in an aggregated manner.

Health Information, Location-Based Information, Personal Information, and Technical Information (collectively, “Information”) that Consumers, Patients, Employers, Insurers or Healthcare Providers provide or that we collect from Consumers, Patients or Healthcare Providers, will be kept confidential and used to support use of the Site, Application or Services by Patients, Healthcare Providers, and Producers (defined below) and applications that interact with it. Except as required by law, as between us, the Consumer, Patient, Employer, Insurer or Healthcare Provider, the Consumer or Patient owns all right, title, and interest in and to any Information (excluding Technical Information, information obtained through 3rd party data services and anonymized, aggregated data) that we collect from the Consumer, Patient, Employer, Insurer or Healthcare Provider via their use of and interaction with the Site, Application or Services.
Disclosure of Information to Third Parties
We may also disclose your Information under the following circumstances:
- If we respond to subpoenas, court orders or legal process, or if we need to establish or exercise our legal rights or defend against legal claims.
- If we believe it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service or as otherwise required by law.
- If we believe it is necessary to restrict or inhibit any user from using the Site, Application or Services, including, without limitation, by means of “hacking” or defacing any portion thereof.

You acknowledge and agree that we are not responsible for any information you share with your Healthcare Provider through any of the functionality offered by the Site, Application or Services. However, this information is limited to you, your Healthcare Provider, and other professionals they may choose to share it with within their organization or as afforded by HIPPA.
